LIMITED PRODUCT WARRANTY

Desert Brand Sealers covered by this limited warranty are:

• Classic Sealer • Concrete, Masonry, Floor Paint and Sealer (CMFPS)

• Del Rio Seal II • Lacquer Sealer • Master Seal & Master Seal WB • Paver Sealer • Penetrating Sealer • Top Finish • Total Sealer

The above Desert Brand Products (manufactured and owned by Hill Brothers Chemical Company) are warranted for a period of one year from the date of purchase when applied as directed on the label instructions or the most updated application speci cation documents. Hill Brothers warrants all products listed above to be of merchantable quality, free from manufacturing defects, and conform to product speci cations as distributed by Hill Brothers/Desert Brand. This limited warranty is valid only when these products are applied in strict accordance to label directions including any substrate and weather conditions, or any other application conditions listed on the label or application speci cation documents. Hill Brothers does not warrant these products for uses other than those listed on the label or any speci cation documents. Hill Brothers assumes no responsibilities for workmanship, application, or proper maintenance of the product. The exclusive and sole remedy shall be that Hill Brothers will supply replacement material if the original material is tested and proven defective and provided that no longer than one (1) year has elapsed since the original date of purchase. As to any claim of any nature, whether in contract, tort, strict liability, patent infringement or otherwise, Hill Brothers’ total liability shall not exceed the replacement of the product. Any litigation arising out of this warranty must be brought in the Superior Court of California, County of Orange. IN NO EVENT SHALL HILL BROTHERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR CONTINGENT DAMAGES, COST OF LITIGATION OR FOR ANY LOSS BEYOND REPLACEMENT OF PRODUCT. THIS LIMITED WARRANTY CONSTITUTES THE ONLY WARRANTY MADE BY HILL BROTHERS; THERE ARE NO OTHER GUARANTEES OR WARRANTIES, EXPRESSED OR OTHERWISE, MADE BY HILL BROTHERS OR ANY OF ITS SUBSIDIARIES.
