TEN (10) YEAR EXCLUSIVE LIMITED PRODUCT WARRANTY DESERT CRETE DECKING SYSTEM

The Desert Crete Decking System, using only the components as de ned in the UES Evaluation Report ER 586 or the most current CSI application speci cation document, is designed and warranted for professional application only. Hill Brothers Chemical Company (manufacturer and owner of Desert Brand Products) warrants all products manufactured by Hill Brothers when used as directed for the Desert Crete Decking System to be of merchantable quality, free from manufacturing defects, and to conform to product speci cations as distributed by Hill Brothers/Desert Brand. Providing the decking system is installed in strict accordance to the UES Evaluation Report ER 586 or the most current CSI application speci cation document, including any substrate, weather, or any other application conditions speci ed, the components manufactured by Hill Brothers for the Desert Crete Decking System are warranted for a period of ten (10) years from the date of purchase when installed by a Desert Brand Authorized Applicator (DBAA) and inspected, maintained, and re-sealed by a DBAA with Desert Brand Sealer ve (5) years from the install date. Proof of purchase for all components and re-seal of the Desert Crete Decking System is required for warranty claim. Hill Brothers does not warrant these products for uses other than those intended in the UES Evaluation Report ER 586 or most current CSI application speci cation document. Hill Brothers assumes no responsibility for workmanship, application, or proper maintenance of the products, or of the completed decking system. The sole remedy of Installer under this warranty shall be that Hill Brothers will supply replacement materials if it is tested and proven that the original Desert Crete materials were defective and provided that no longer than one (1) year has elapsed since their original purchase, or no longer than ve (5) years has elapsed since their original purchase when the Desert Crete Decking System is installed by a DBAA. As to a claim of any nature, whether in contract, tort, strict liability, patent infringement, or otherwise, Hill Brothers’ total liability shall not exceed the replacement of the portion of the products. Any litigation arising out of this warranty must be brought in the Superior Court of California, County of Orange. IN NO EVENT SHALL HILL BROTHERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR CONTINGENT DAMAGES, COSTS OF LITIGATION, OR FOR ANY LOSS BEYOND REPLACEMENT OF PRODUCT. THIS LIMITED WARRANTY CONSTITUTES THE ONLY WARRANTY MADE BY HILL BROTHERS; THERE ARE NO OTHER GUARANTEES OR WARRANTIES, EXPRESSED OR OTHERWISE, MADE BY HILL BROTHERS OR ANY OF ITS SUBSIDIARIES.
